7. Indemnification

9. Termination

FitCoachPro may terminate your access to the Website, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to this Agreement shall be filed only in the state or federal courts located in San Francisco County, Oklahoma, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

11. Entire Agreement

This Agreement constitutes the entire agreement between you and FitCoachPro regarding the use of the Website and supersedes all prior agreements between you and FitCoachPro. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions of the Agreement shall remain in full force and effect.
